This Domain Name Registration Agreement ("DNR Agreement") is an integral part of the overall Terms and Conditions of Service and the Acceptable Use Policy for Internetivo.com. By registering, renewing, transferring, or otherwise managing a domain name through Internetivo.com, you expressly agree to the terms set forth below.
1. Domain Registration and Management Services
Internetivo.com acts as a reseller or facilitator of domain registration services, utilizing third-party domain registrars accredited by the Internet Corporation for Assigned Names and Numbers (ICANN) or other relevant registries. We are responsible only for transmitting your registration request and managing the billing interface for these services.
2. Customer’s Sole Responsibility
The Customer (You) accepts full and sole responsibility for the entire lifecycle management of all domain names registered, transferred, or renewed under your account, including ensuring the accuracy of contact information and maintaining up-to-date payment details.
3. Exclusion of Liability for Domain Incidents
Internetivo.com explicitly disclaims any and all liability, responsibility, and warranty for issues related to the successful operation, security, or management of any domain name.
By using our domain services, you agree that Internetivo.com is not responsible for, and you release Internetivo.com from, any and all liability arising from or related to the following domain incidents, regardless of cause (including, but not limited to, human error, technical failure, or third-party action):
Non-Renewal or Expiration: Failure of a domain name to be successfully renewed resulting in the domain's expiration, lapse, or entry into the redemption or deletion phase. This includes failures arising from outdated payment information, non-payment, communication failures, or internal system errors.
Transfer Failures: Any failure, delay, or denial in the successful transfer of a domain name to or from Internetivo.com, including issues related to authorization codes (EPP keys) or registry locks.
Suspension or Loss: Any suspension, cancellation, or permanent loss of the domain name due to actions taken by the Customer, the underlying Registry (e.g., ICANN, EURid), or other third parties.
Security Incidents: Any unauthorized access, hacking, theft, unauthorized transfer, or modification of a domain name's settings, records, or ownership details.
DNS Resolution Issues: Any problems related to the Domain Name System (DNS) that cause the domain or associated services (website, email) to become unreachable, including incorrect configuration of name servers or DNS records by the Customer or third parties.
WHOIS Data: Any consequences arising from the public display or inaccuracy of WHOIS data, including non-compliance with regional data privacy laws relevant to the Customer.
Loss of Data/Service: Any interruption or loss of associated services (e.g., website traffic, email) resulting directly or indirectly from any of the aforementioned domain incidents.
4. Indemnification for Domain Incidents
You agree to indemnify, defend, and hold harmless Internetivo.com, its directors, employees, and agents from any and all claims, damages, liabilities, and expenses (including reasonable legal fees) arising from any loss, corruption, suspension, or non-renewal of any domain name registered under your account.
5. Domain Renewal Responsibility
You acknowledge and agree that, while Internetivo.com may provide renewal reminders as a courtesy, the provision of such reminders is not guaranteed. The sole and absolute responsibility for tracking expiration dates and ensuring timely renewal payments rests exclusively with you. Failure to receive a renewal notice does not relieve you of your obligation to renew the domain.
